Green Cloud Websites strive to make things as simple as possible, including our Terms and Conditions.
Deposit - We will require a deposit before we start work on your website. This includes the draft. During the initial discussion phase, once we've established what the services required are, we will send you a quote that outlines the work to be done and the costs. There will be an initial deposit of 50% of the total bill, which is to be settled before commencement. This deposit is not refundable, however, on a case by case basis we reserve the right, as needed, to make exceptions to this under certain circumstances. Change of mind is not included.
Final Payment - Once we have completed the website, we require you to pay the remaining balance of your invoice before we hand over the website.
Ongoing Charges - If you are utilizing services that are on an ongoing basis, such as web hosting, domain registration or others, we will bill you for these before the due date. If payment is not made for these services, they will be suspended. If there are ongoing charges, this will be clearly outlined in your quote and invoice. No hidden surprises!
Ownership - Once there is no money outstanding to Green Cloud Websites, then full ownership of the completed website is transferred to you. Please note that the original files are the property of Green Cloud Websites, however, in certain situations, we will release those files to you. If you wish to have the original files and code, then they can be provided upon request. Email [email protected] to request it. Please note that there will be a fee of $100 for the original website files and code. Under certain circumstances, at our discretion, we may lower or waive that fee. Some websites, for example Wordpress based sites are complicated and aren't in the form of files and can often require significant work to move to another server.
Additional Work - Unless agreed during the initial discussion, and reflected on the quote and invoice, extra work done to the website after completion of the website, will be undertaken for a fee. This could be an hourly fee, or a flat rate fee, depending on the type of work to be done. Adding extra pages, extra features or similar will attract extra fees. At our discretion, we may choose to waive extra charges. Please note that fixing typos, rewording text, or making trivial edits will not attract any fees.
Refunds - Green Cloud Websites does not usually offer refunds, except where required under Australian Consumer Law. The initial deposit is not usually refundable - except where required by law, or at our discretion. If you feel that the work done was not satisfactory after payment of your initial deposit, please contact us at [email protected] to resolve any issues first. If we're unable to do what we quoted, then we will process a refund. Upon completion of the website, and at the final invoice stage, you have an opportunity to express concerns before committing payment. By paying the final invoice, you have agreed that it is what you wanted and without problems. If you have paid your final invoice and feel that there is a reason to be refunded, please contact us at [email protected] and we will work with you to rectify any issues.
Liability - By using the services provided by Green Cloud Websites, you agree to indemnify Green Cloud Websites of any liabilty in relation to any loss or damage. This is a standard liability waiver, unfortunately in the society we live in, it's necessary to explain that if we build you a website and for some reason your business burns to the ground, it's not our fault.
Service Level Guarantees - This really only applies to web hosting. If you are hosting your website using our servers, we promise that it will be online without interruption as much as is humanly possible. Due to the nature of such systems, things outside of our control such as natural disasters, political events, disruptions to electricity, Internet, third parties can reduce the availability of services. Nobody can claim they offer 100% availabilty and mean it. We will take all reasonable steps to ensure there are no losses of availability.
Backups - Under no circumstances will Green Cloud Websites be held accountable for data loss. This means data loss caused either by you or by us. We take a ridiculously careful approach to handling data and backing up, however sometimes even backups can fail. It is your responsibility to ensure you have backups of anything crucial. If in the extremely unlikely event that data loss occurs, we will do absolutely every reasonable step to attempt to retrieve it but we cannot possibly guarantee anything. Please, if you think there's a chance data could be lost, back it up first. If you're unsure how to back up, please contact [email protected] and we'd be happy to assist. Note that this mainly relates to situations where you are using hosting provided by another provider and you choose to upload the files yourself. Some websites have databases as well as files, which also need to be backed up on their own.
